Can an emergency room error be termed medical negligence?

Errors can be made in an emergency situation, even by experts, and it may not amount to negligence. In one of the cases, the Supreme Court of India has observed: “The higher the acuteness in an emergency and the higher the complication, the more are the chances of error of judgment. ….”
